1. ABOUT US

  1. Gormal One LLP (‘we’/ ‘Gormal One’) builds applications that will help many farmers, service providers and other users to capture, store, review and analyze cattle and farm related data. Our services include: NITARA App, NITARA Farmer App, NITARA Friend, NITARA FarmPro App for Web and Mobile devices.
  2. When you use our services, you’re trusting us with your information. We understand this is a big responsibility and work hard to protect your information and put you in control.
  3. Nitara respects the privacy of its users. The purpose of this privacy statement ("NITARA Privacy Policy") is to give you information on how NITARA collects, stores, uses, discloses, transfers and processes your Personal Information (defined below) when you use our websites ("Website(s)"), software applications or mobile applications for availing our services ("Apps"), any transaction platforms, one or more of the payment mechanisms provided through our platforms/websites or our checkout pages ("Platforms"), including the steps we take to protect your Personal Information. Please note that by visiting https://gormalone.com , https://nitara.ai , https://nitara.co.in and https://nitara.farm (“Website”) you are accepting the practices described in this Privacy Policy. All users of the Website are advised to read and understand our Privacy Policy carefully before registering, accessing or using the Website or any NITARA service. By giving your consent for availing NITARA services, you agree to be bound by the terms and conditions of the Privacy Policy and consent to the collection, storage and use of information relating to you as provided herein and our use and disclosure of your personal information in accordance with this Privacy Policy.

2. INFORMATION WE COLLECTS

  1. We collect, use your personal information and non-personal information and process your personal data in accordance with the IT Act, 2000 and other national and state laws which relate to processing of personal data.
    1. Personal Information: We collect personal data necessary for user account creation, service delivery, identity verification, and enhanced user experience, including: Name, email address, phone number, username, and other identifiers; KYC documentation (e.g., Aadhaar, PAN, driving license) for verification; Educational and professional experience (for service eligibility); Content you upload or create (photos, videos, documents); Feedback, reviews, and communications in order to provide and continually improve our products and services.
    2. Usage Data: We automatically collect certain information when you interact with our website or apps, including: Device information (type, name, operating system, time zone); IP address, browser type and settings, application version; Usage behavior (pages visited, time spent, actions taken); Crash reports, system activity, and referrer URLs. This information is compiled and analysed on an aggregated basis. This information may include your device information.
    3. Location Data: If you enable location features, we may collect and use your device’s location to:
      • Schedule appointments efficiently;
      • Deliver location-specific services (alerts, weather, financial assistance);
      • Connect you with nearby service providers.
      Location accuracy depends on your device and settings. You can manage location permissions in your device’s settings. For example, you can turn your Android device’s location on or off using the device’s settings app and on iOS, you can manage location settings in the 'Privacy' section of your device’s settings.
    4. Cookies and Tracking Technologies: We use cookies and similar technologies to enhance your experience and analyze usage.
  2. How we collect the information:
    1. Directly from you and through NITARA Apps: We may collect information from the NITARA Apps when you visit, register, create an account, upload content, or otherwise interact with our Apps.
    2. When you’re not signed into the NITARA Account, we store the information we collect with unique identifiers tied to the browser, application, or device you’re using. This includes Device information like Device name, Type, Time Zone amongst others. This helps us do things like maintain your language preferences across browsing etc.
    3. Through business interaction: We may collect information through business interaction with you or your employees.
    4. From Third-Party sources: We may receive information from other sources, such as third-party databases, joint marketing partners and collect personal information for providing better services.

      Third-Party Services: Our Application may also integrate third-party services to help us operate, provide, improve, understand, customize, support, and market our Services such as Google Maps, payment gateways, analytics providers, and other external tools. These third parties may collect and process your Personal Information, including but not limited to location data, payment details, and usage analytics.

      We do not control how these third-party services collect, use, or store your data. By using these services within our application, you agree to their respective privacy policies, which apply independently from our Privacy Policy.

      For example, if you use our location-based features, your data may be processed under the Google Maps Privacy Policy (Google Privacy Policy).

    5. Account and Service Usage:
      • When you create a NITARA Account, you provide us with personal information such as your name, phone number, and KYC details. The system may generate a random PIN for account access.
      • Even if you are not signed in, you may provide information (e.g., email address for updates).
      • We also collect the content you create or upload when using our services. This includes things like photos and videos you save, docs and spreadsheets you create.
      • The information that you provide us will be stored with us for a period of 30 days from the time you delete your NITARA account or your account becomes inactive.
      • End-Users using the Application by registering for an account on the ‘NITARA’ mobile application: You can create an account by giving us information regarding your name and mobile number, and such other information as requested on the End User registration Page. This is to enable us to provide you with the facility to use the account to book your appointments and store other Animal health related information.
  3. Device and Feature Access
    1. Camera and Gallery: We may request access to your camera or gallery to enable you to upload images for analysis and service improvement and provide you meaningful solution.
    2. SMS: Access is required for SMS-based user verification/OTP authentication.
    3. Storage: We may request permission to access your device’s storage to save and retrieve data relevant to your use of our services. If you wish to change the access or permissions for the app, you may choose to do so in your device’s settings.
  4. Information we collect as you use our services.
    1. We collect information about the browsers and devices you use to access NITARA services.
    2. The information we collect includes browser type and settings, device type and settings, operating system, phone number, and application version number. We also collect information about the interaction of your apps, browsers, and devices with our services, including IP address, crash reports, system activity, and the date, time, and referrer URL of your request.
    3. We collect this information when a NITARA service on your device contacts our servers — for example, when you install an app from the Play Store or App Store or when a service checks for automatic updates. If you’re using an Android or iOS device with NITARA apps, your device periodically contacts NITARA servers to provide information about your device and connection to our services. This information includes things like your device type, crash reports, and which apps you've installed.
    4. NITARA may keep records of electronic communications and video calls received and made for making appointments or other purposes for the purpose of administration of Services, customer support, research and development and for better listing of Service Providers.
    5. We use various technologies to collect and store information, including cookies, local storage, such as browser web storage or application data caches, databases, and server logs.

3. WHY NITARA COLLECTS DATA

  1. We use data to build better services to all of our customers. We use information we collect primarily to provide, maintain, protect and improve our current products and services.
  2. We use the information we collect from all our services for the following purposes:
    1. Provide our services: We use your information to deliver our services, like connecting you with Service Providers such as Artificial Insemination Technicians, Vets and Para Vet in your area, provide alerts and reminders for your critical farm activities.
    2. Maintain & improve our services: We also use your information to ensure our services are working as intended and make improvements to our services.
    3. Develop new services: We use the information we collect in existing services to help us develop new ones.
    4. Measure performance: We use data for analytics and measurement to understand how our services are used. For example, we analyze data about your usage of our application to do things like optimize product design.
    5. Communicate with you: We use information we collect, like your phone number, to interact with you directly. For example, we may send you notifications via SMS or WhatsApp for reminders of critical farm activities. Or we may let you know about upcoming changes or improvements to our services. And if you contact Nitara, we’ll keep a record of your request in order to help solve any issues you might be facing.
    6. Protect NITARA, our users, and the public: We use information to help improve the safety and reliability of our services. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues that could harm NITARA, our users, or the public.
  3. We use different technologies to process your information for these purposes. We use automated systems that analyze your content to provide you with things like customized search results. We also use algorithms to recognize patterns in data.
  4. We may combine the information we collect among our services and across your devices for the purposes described above.
  5. We’ll ask for your consent before using your information for a purpose that isn’t covered in this Privacy Policy.
  6. We may process your personal information without your knowledge or consent where required by applicable law or regulation for the purposes of verification of identity or for prevention, detection, or investigation, including of cyber incidents, prosecution and punishment of offences.
  7. Protect, investigate, and deter against fraudulent, unauthorized or illegal activity.
    1. Account Deletion and Data Erasure: You have the right to request deletion of your account and personal data at any time. Upon receiving such a request, or if you withdraw your consent to the processing of your personal data, we will erase your personal data within 30 days, unless retention is required by law or for compliance with regulatory obligations.
      • To delete your information, you can: Delete your entire NITARA Account
    2. There are other ways to control the information NITARA collects whether or not you’re signed into a NITARA Account, including:
      • Browser settings: For example, you can configure your browser to indicate when NITARA has set a cookie in your browser. You can also configure your browser to block all cookies from a specific domain or all domains. But remember that our services rely on cookies to function properly, for things like remembering your language preferences.
      • Device-level settings: Your device may have controls that determine what information we collect. For example, you can modify location settings, language, time settings on your Android device or iOS device. On Android, you can adjust these settings through the device's settings app. On iOS, you can modify them through the 'Settings' app under relevant sections, such as 'Location Services,' 'Language & Region,' and 'Date & Time.'

4. WHEN NITARA SHARES YOUR INFORMATION

Information about our users is an important part of our business and we take due care.

  1. We do not share your personal information with companies, organizations, or individuals outside of NITARA except in the following cases:
    1. With your consent: We’ll share personal information outside of NITARA when we have your consent.
    2. With domain administrators: If you’re associated or work for an organization that uses NITARA services, your domain administrator and resellers who manage your account will have access to your NITARA Account. They may be able to:
      1. Access and retain information stored in your account, like your phone number.
      2. View statistics regarding your account
      3. Change your account password.
      4. Suspend or terminate your account access.
      5. Receive your account information in order to satisfy applicable law, regulation, legal process, or enforceable governmental request.
      6. Restrict your ability to delete or edit your information or your privacy settings.
    3. For external processing: We provide personal information to our affiliates and other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.
    4. For legal reasons: We will share personal information outside of NITARA if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:
      1. To comply with the applicable laws, regulation, legal process, or enforceable governmental request.
      2. To comply with a valid legal request or to respond to claims asserted against NITARA / Gormal One.
      3. Enforce applicable Terms of Service, including investigation of potential violations.
      4. Detect, prevent, or otherwise address fraud, security, or technical issues.
      5. Protect against harm to the rights, property or safety of Nitara, our users, or the public as required or permitted by law.
  2. We may share non-personally identifiable information publicly and with our partners — like publishers, advertisers, developers, or rights holders. For example, we share information publicly to show trends about the general use of our services. We also allow specific partners to collect information from your browser or device for advertising and measurement purposes using their own cookies or similar technologies.
  3. If NITARA is involved in a merger, acquisition, or sale of assets, we will continue to ensure the confidentiality of your personal information and notify affected users before personal information is transferred or becomes subject to a different privacy policy.

5. KEEPING YOUR INFORMATION SECURE

  1. We build security into our services to protect your information.
  2. We take due care to protect customer data. Technical measures are in place to prevent unauthorized or unlawful access to data and against accidental loss or destruction of, or damage to the data. The employees who are dealing with the data have been trained to protect the data from any illegal or unauthorized usage.
  3. We work hard to protect you and NITARA from unauthorized access, alteration, disclosure, or destruction of information we hold. All NITARA products are built with strong security features that continuously protect your information. The insights we gain from maintaining our services help us detect and automatically block security threats from ever reaching you. And if we do detect something risky that we think you should know about, we’ll notify you and help guide you through steps to stay better protected.
  4. We take reasonable steps to help protect your personal information in an effort to prevent the loss, misuse and unauthorized access, disclosure, alteration and destruction. It is your responsibility to protect your usernames and passwords to help prevent anyone from accessing or abusing your accounts and services. You should not use or reuse the same passwords you use with other accounts as your password for our services.
  5. It is important for you to protect against unauthorized access to your password and your devices, and applications. Be sure to sign off when you finish using a non-personal device.
  6. The information you provide to us is shared on our secured servers. We have implemented appropriate physical, technical and organizational measures designed to secure your information against accidental loss and unauthorized access, use, alteration, or disclosure. In addition, we limit access to personal data to those employees, agents, contractors, and other third parties that have a legitimate business need for such access.
  7. Information collected from you will be stored for such period as required to complete the transaction entered into with you or such period as mandated under the applicable laws.
  8. We work hard to protect you and NITARA from unauthorized access, alteration, disclosure, or destruction of information we hold, including:
    1. We use encryption to keep your data private while in transit.
    2. We offer a range of security features, like Safe Browsing, Security check-up, and 2 Step Verification to help you protect your account.
    3. We review our information collection, storage, and processing practices, including physical security measures, to prevent unauthorized access to our systems.
    4. We restrict access to personal information to NITARA employees, contractors, and agents who need that information in order to process it. Anyone with this access is subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

6. SHARING OF PERSONAL INFORMATION

  1. We do not share your personal data with third parties without your prior consent other than:
    1. with third parties who work on our behalf provided such third parties adhere to the data protection principles set out in the IT Act, 2000 (21 of 2000) and other applicable legislation, or enter into a written agreement with us requiring that the third party provide at least the same level of privacy protection as is required by such principles;
    2. To comply with laws or to respond to lawful requests and legal processes;
    3. To protect the rights and property of us, our agents, customers, and others including to enforce our agreements, policies and terms of use;
    4. In an emergency, including to protect the personal safety of any person; and
    5. For the purpose of a business deal (or negotiation of a business deal) involving the sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger financing, acquisition, divestiture or bankruptcy transaction or proceeding.)

7. COMPLIANCE & COOPERATION WITH REGULATORS

  1. We regularly review this Privacy Policy and make sure that we process your information in ways that comply with it.
  2. Applicability
    1. This Privacy Policy applies to all of the services offered by GormalOne LLP and its affiliates. This Privacy Policy doesn’t apply to services that have separate privacy policies that do not incorporate this Privacy Policy.
    2. This Privacy Policy doesn’t apply to:
      1. The information practices of other companies and organizations that advertise our services
      2. Services offered by other companies or individuals, including products or sites that may include NITARA services, be displayed to you in search results, or be linked from our services
      3. The third-party online store from which you install the Application, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.
  3. Changes to this policy
    1. We reserve the right to change this Privacy Policy from time to time and for any reason.
    2. If we make changes to the Policy, we will change the “Last Updated” date above.
    3. We will not reduce your rights under this Privacy Policy without your explicit consent.
    4. We will alert you about any changes by updating the ‘last updated date’ of this Privacy Policy and we will offer access to archived versions for your review. If changes are significant, we’ll provide a more prominent notice (including, for certain services, in-app notification of Privacy Policy changes).
    5. You are encouraged to periodically review this Privacy Policy to stay informed of updates.
    6. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

8. KEY TERMS

  1. Algorithm
    A process or set of rules followed by a computer in performing problem-solving operations.
  2. Application data cache
    An application data cache is a data repository on a device. It can, for example, enable a web application to run without an internet connection and improve the performance of the application by enabling faster loading of content.
  3. Browser web storage
    Browser web storage enables websites to store data in a browser on a device. When used in "local storage" mode, it enables data to be stored across sessions. This makes data retrievable even after a browser has been closed and reopened. One technology that facilitates web storage is HTML 5.
  4. Cookies
    A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the site again, the cookie allows that site to recognize your browser. Cookies may store user preferences and other information. You can configure your browser to refuse all cookies or to indicate when a cookie is being sent. However, some website features or services may not function properly without cookies.
  5. Device
    A device is a computer that can be used to access NITARA services. For example, desktop computers, tablets and smartphones are all considered devices.
  6. NITARA Account
    You may access some of our services by signing up for a NITARA Account and providing us with some personal information (typically your name, phone number, and a password). This account information is used to authenticate you when you access NITARA services and protect your account from unauthorized access by others. You can edit or delete your account at any time through your NITARA Account settings.
  7. Non-personally identifiable information
    This is information that is recorded about users so that it no longer reflects or references an individually-identifiable user.
  8. Personal information
    This is information that you provide to us which personally identifies you, such as your name, phone number, or billing information, or other data that can be reasonably linked to such information by NITARA, such as information we associate with your NITARA Account.
  9. Referrer URL
    A Referrer URL (Uniform Resource Locator) is information transmitted to a destination webpage by a web browser, typically when you click a link to that page. The Referrer URL contains the URL of the last webpage the browser visited.
  10. Server logs
    Like most websites, our servers automatically record the page requests made when you visit our sites. These “server logs” typically include your web request, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser.
  11. Ensure our services are working as intended
    For example, we continuously monitor our systems to look for problems. And if we find something wrong with a specific feature, reviewing activity information collected before the problem started allows us to fix things more quickly.
  12. Make improvements
    For example, we use cookies to analyze how people interact with our services. And that analysis can help us build better products. For example, it may help us discover that it’s taking people too long to complete a certain task or that they have trouble finishing steps at all. We can then redesign that feature and improve the product for everyone.

9. GRIEVANCE REDRESSAL CONTACT

In case you have any complaints or grievance pertaining to:

  1. Any User Content that you believe violates these Terms (other than an infringement of Intellectual Property Rights) for the reporting mechanism for such claims,
  2. Your access to the Application Platform, or
  3. Any User Content which you believe is, prima facie, in the nature of any material which is obscene, defamatory towards the complainant or any person on whose behalf you are making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by writing to: grievance@gormalone.com .

In your complaint or grievance, please include the following information:

  1. Your name and contact details: name, address, contact number and email address;
  2. Your relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person;
  3. The name and age of the person aggrieved or affected by the subject matter of the complaint, in case you are acting on behalf of such person and a statement, under penalty of perjury, that you are authorised to act on behalf of such person and to provide such person's personal information to us in relation to the complaint/grievance;
  4. Description of the complaint or grievance with clear identification of the User Content in relation to which such complaint or grievance is made;
  5. A statement that you believe, in good faith, that the User Content violates these Terms;
  6. A statement that the information provided in the complaint or grievance is accurate.

The Company respects the Intellectual Property Rights of others. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Platform belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners. You are requested to send us a written notice/intimation if you notice any act of infringement on the Platform, which must include the following information:

  1. A clear identification of the copyrighted work allegedly infringed;
  2. A clear identification of the allegedly infringing material on the Application Platform;
  3. Your contact details: name, address, e-mail address and phone number;
  4. A statement that you believe, in good faith, that the use of the copyrighted material allegedly infringed on the Application Platform is not authorized by your agent or the law;
  5. A statement that the information provided in the notice is accurate, and under penalty of perjury, that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed;
  6. Your signature or a signature of your authorized agent.

On receiving such complaint, grievance or notice, the Company reserves the right to investigate and/or take such action as the Company may deem appropriate. The Company may reach out to you to seek further clarification or assistance with the investigation, or verify the statements made in your complaint, grievance or notice, and you acknowledge that your timely assistance with the investigation would facilitate the redressal of the same.
